Content Removal: reporting and takedown
Weared, in its capacity as an intermediary, provides a clear mechanism allowing anyone to report content that is unlawful, harmful or contrary to our rules, and to obtain its prompt removal where the report is well-founded.
1. Who can report
Any person — member or third party — may report content they consider unlawful or contrary to our rules: an image published without consent, misappropriation, content involving a minor or the appearance of minority, non-consent, or anything appearing on the Prohibited items page.
2. How to report
A report is submitted through the site's confidential channels. For efficient handling, it should specify:
- Identification of the content concerned (link, reference, screenshot);
- The reason for the report;
- Where relevant, the capacity of the reporter (person concerned, rights holder, third party);
- Any element useful to the assessment.
Good-faith reports are handled seriously and confidentially.
3. Handling and timescales
Weared examines every report with diligence. Manifestly unlawful content or content in serious breach of our rules (minors, non-consent, misappropriation) is subject to priority removal without delay. Other reports are dealt with within a reasonable time, allowing for a right of reply where appropriate.
4. Possible measures
Following the review, Weared may: remove or hide the content, suspend the listing, restrict or terminate the account, retain the evidence and, where an offence is present, cooperate with the Swiss authorities. The reporter is informed, as far as possible, of the action taken.
5. Notice and appeal for the author
The member whose content is removed is informed of the reason, as far as possible, and may request a review through the confidential channels. This internal appeal mechanism draws on the spirit of the DSA. It does not apply where removal is imposed by manifest seriousness or a legal obligation.
6. Abuse of reporting
Manifestly unfounded, repeated or bad-faith reports may result in measures against their author. The removal mechanism is a tool of protection, not an instrument of harassment.
7. Scope
References to the DSA constitute a source of inspiration; Weared, a Swiss entity, applies Swiss law and Swiss jurisdiction. This mechanism is implemented with diligence, without any guarantee of exhaustiveness, primary responsibility remaining with the author of the content.
