Terms and Conditions of Use

These terms govern access to and use of the Weared platform, its introduction, direct member-to-member payment and neutral shipping services. Weared caters to a clientele established in Switzerland or France and operates in Swiss francs (CHF) and euros (EUR), depending on the member's country.

Except in a guaranteed purchase (Art. 5), Weared is not a party to the sales contract concluded between a selling member and a buying member. Our role is limited to providing a discreet, secure and compliant technical framework.

Access to Weared is strictly reserved for persons who have reached the age of 18. By registering, you declare and warrant that you are of full age under Swiss law and have full capacity to contract.

Verification is a precondition for any transaction; the catalogue stays open to browse. Sellers verify their identity (identity document and verification video). Buyers are verified either the same way or through their first card payment; a purchase without an account is paid by card, with a declaration of majority. Details are on our Verification page. Any account for which minority is established or suspected is immediately suspended, without notice or refund.

Identity verification is carried out by our provider Didit (Spain — EU). Weared receives no copy of the document, no photo and no photo and verification video — only the result, the date, a control reference and your date of birth. No name or address is ever transmitted to Weared. The identity photo and the verification video remain with the provider, where they are automatically deleted after one month.

Weared is founded on a principle of pseudonymity between members. Sellers and buyers know one another only by pseudonym. No real contact details are exchanged directly between the parties: communications pass through the platform and shipping is carried out via a neutral pickup point; if the buyer chooses home delivery or a named pickup point, the name and address they provide are passed to the seller for shipping.

You are solely responsible for the confidentiality of your login credentials and for all activity carried out from your account. A pseudonym never exempts you from the internal checks required at registration.

Only worn underwear and related worn items, described accurately and offered with respect for personal dignity, are permitted. Every listing must remain of a suggestive and tasteful register, without explicit content.

The list of prohibited content and practices appears on our Prohibited items page. It includes, without limitation, anything involving minors or the appearance of minority, non-consent, hazardous fluids, violence, narcotics, weapons, animals, prostitution, escorting, physical meetings and the misuse of images. Any breach results in immediate removal and termination of the account.

Depending on the seller and the option chosen, payment is made: a) in Bitcoin (Lightning), directly from the buyer to the seller, to the payment address she has provided — the funds then do not pass through Weared and the seller is paid as soon as the purchase is made; b) by card, through our provider Stripe — Weared collects the price and pays it on to the seller, less commission, once shipment has been evidenced; c) as a guaranteed purchase (below).

The house commission amounts to 25% (Free), reduced to 20% with the Pro subscription (from CHF 39 or EUR 39 / month) and to 15% with the Max subscription (from CHF 89 or EUR 89 / month). It is settled by the seller in the form of prepaid credits for sales paid in bitcoin, and withheld from the amount paid on for sales paid by card; it is never added to the price paid by the buyer. The applicable amounts and the terms of any dispute are specified for each transaction.

Credits and subscriptions are digital services provided by Weared and performed upon activation: to the extent permitted by law, they are neither refundable nor convertible, including where an account is suspended or terminated for breach of these terms. Weared may adjust its prices at any time, with effect for the future.

Guaranteed purchase. Any buyer may, for a fee shown at the time of the order and up to the maximum amount indicated, opt for a guaranteed purchase, payable by card or in bitcoin. In that case, and only in that case, Weared acquires the item from the seller and resells it to the buyer in its own name and on its own account: the sales contract is concluded with Weared, the price paid by the buyer constitutes its turnover, and the acquisition price owed to the seller constitutes a trade debt, settled once shipment has been evidenced. Failing evidenced shipment within the announced period, the sale is cancelled and the price refunded. The fee and the maximum amount per item are indicated at the time of the order. The exclusion of returns under Art. 7 remains applicable.

Pro and Max subscriptions and the buyer subscription can be paid by Visa or Mastercard, including through Apple Pay or Google Pay, or in bitcoin (Lightning). Card payments are operated by Stripe (Stripe Payments Europe Ltd, Ireland): the member is redirected to a payment page hosted by that provider, which states the amount, the billing period and the date of the first renewal before any confirmation. Weared neither receives nor stores card details.

Term and renewal. A subscription paid by card is entered into for the chosen term — monthly, quarterly or half-yearly — and renews automatically for an identical term at each due date, at the rate then in force, until cancelled. The amount is charged at each renewal. A subscription paid in bitcoin does not renew: it runs for a fixed term and lapses on its own.

Cancellation. A member may cancel at any time, without reason or notice, from the management area reached through the « Manage my subscription » link on their subscription page. Cancellation takes effect at the end of the current period: the tier and its benefits remain until that date, and no pro-rata refund is due for the period already started.

Failed payment. If a charge fails, the payment provider retries for a few days. Failing regularisation, the subscription ends and the account returns to the free tier once the period already paid for has elapsed. Credits already added to the account remain acquired.

Change of plan and of price. Moving from one tier to another takes effect as stated at the time of the change. Weared may adjust its prices for the future; a new price applies only to due dates after it comes into force, the member remaining free to cancel beforehand.

Items are shipped in plain packaging, bearing nothing that could identify Weared or the nature of the contents, to a pickup point or an address provided by the buyer, depending on the options available in their country. Pickup-point collection preserves the anonymity of both parties and avoids any home delivery.

The seller chooses which countries she serves. For a cross-border shipment, customs formalities fall to the sender and any duties, taxes and import charges are payable by the buyer; delivery is then made to a postal address.

Delivery times depend on the postal and customs services involved and cannot engage Weared's liability beyond its role as an intermediary.

Items sold on Weared are worn underwear. For hygiene reasons they cannot be taken back, exchanged or refunded once shipped. By placing an order, the buyer acknowledges having been informed of this before the purchase.

This exclusion rests on the hygiene exception: goods sealed, unsealed after delivery and unsuitable for return for health-protection reasons are excluded from the right of withdrawal (Art. 16(e) of Directive 2011/83/EU; Art. L221-28 5° of the French Consumer Code for buyers in France). In Switzerland, distance selling grants no statutory right of return in any case.

What remains possible: opening a dispute if the parcel does not arrive, or if the item received does not match the listing. Moderation decides on the evidence — postal tracking, photos, messages. Except in a guaranteed purchase, the decision bears on the account's public reputation, its restriction or its suspension; in a guaranteed purchase, Weared being the seller, it refunds the buyer under the conditions of Art. 5.

Each member warrants that the items offered belong to them, that they were worn by that member, being of full age and consenting, and that offering them for sale infringes no third-party right or any legal provision applicable in their country. Each member is responsible for their own reporting, tax and social security obligations.

• Describe each item honestly;
• Publish no image of a third party without consent;
• Use Weared for no unlawful purpose;
• Respect at all times the dignity and anonymity of other members.

The member indemnifies Weared against any third-party claims (including damages and reasonable defence costs) arising from their content, their items or a use of the platform contrary to these terms or the law.

Weared provides a matchmaking service as a technical intermediary: except in a guaranteed purchase (Art. 5), the platform is not a party to the transactions concluded between members. Each sale is a direct contract between buyer and seller, who alone bear its performance and risks. In direct bitcoin payment, Weared never holds members' funds; in card payment, the price is collected through Stripe and then paid on to the seller (Art. 5).

To the extent permitted by Swiss law, Weared assumes no warranty or liability for the items offered (quality, conformity, hygiene, lawfulness, accuracy of descriptions), their shipping or delivery, or members' conduct. The items are, by nature, worn garments sold “as is”: the buyer accepts their characteristics and assumes all risks, including health-related risks, arising from their use.

Direct bitcoin payments are made without a custodian: they are irreversible, and Weared can neither return, refund nor block funds it does not hold. Card payments follow the rules of Art. 5. Where Weared is itself the seller (guaranteed purchase), the mandatory provisions protecting consumers remain reserved. Disputes over a transaction are settled between the members concerned; Weared may assist (moderation, reports, payment evidence) without being obliged to do so and without any guarantee of outcome.

The platform is provided “as is” and “as available”, without warranty of continuous availability, absence of errors or results — in particular, no sales volume or income is guaranteed to sellers. The verifications offered (age, face) are reasonable checks performed at a given point in time, not a continuous guarantee of a member's identity or conduct. Published content is the sole responsibility of its author; Weared removes it upon substantiated notice, without any general monitoring obligation.

If, notwithstanding the above, Weared's liability were nevertheless established, it is limited, for all causes combined, to the amounts actually paid to Weared by the member concerned (credits and subscriptions) during the twelve months preceding the triggering event; indirect or consequential damages are excluded. Liability for wilful misconduct and gross negligence (art. 100 of the Swiss Code of Obligations) and any mandatory liability remain reserved.

Weared reserves the right to suspend or terminate any account, without notice, in the event of a breach of these terms, suspicion of fraud, prohibited content or conduct contrary to the spirit of the house. Payments already settled directly between members are unaffected by such a measure, as the house is at no point the custodian of that money; commission credits and the Pro / Max subscriptions are handled under their own rules.

These terms are governed by Swiss law. Any dispute falls within the exclusive jurisdiction of the courts of Weared's registered seat in Switzerland, subject to the mandatory provisions protecting consumers.

Three flows coexist. Direct payment in bitcoin: the buyer pays the seller to her own payment address; no amount passes through Weared. Card payment: the price is collected by our provider Stripe and then paid on to the seller, less commission, once shipment has been evidenced. Guaranteed purchase: Weared acquires the item and resells it in its own name and on its own account; what it owes the seller is a trade debt.
